Democracia y minorías discretas e insulares
Keywords:
civil rights, Black Lives Matter, George Floyd, democracy, discrete and insular minoritiesAbstract
The present work analyzes the phenomenon of racism from the perspective of universal rights, the Black Lives Matter movement and the George Floyd case. First, we will examine the issue of racial segregation and civil rights from the normative framework of the Constitution of the United States of America and the ruling Brown v. Board of Education. Secondly, we will analyze law as an element of change and transformation based on the reflection of the great masters of law Owen Fiss and Oliver Wendell Holmes. Thirdly, we will study equality and freedom as universal values, from the theory of Thomas Paine and the amendments to the US Constitution. Fourthly, we will review the case of George Floyd and its implications in the Black Lives Matter movement. Finally, we will address some issues relating to democracy and discrete and insular minorities from the vision of two great masters of law, Ronald Dworkin and Daniel Ackerman. We will end with the formulation of some conclusions, by way of proposals, aiming to lead the reader to reflection.
